Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the MasterTech website at mastertech.work and any content, forms, job listings and services we make available through it (together, the “Site”). By using the Site you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

Who We Are

MasterTech is a permanent search recruitment agency for Skilled Trades. We source, screen and present candidates to employers across the United States and Canada. The Site describes those services and lets job seekers and employers get in touch with us.

Use of the Site

You may use the Site for lawful purposes only, and only to explore, apply for or request recruitment services. You agree not to scrape, copy or harvest content or contact details from the Site, interfere with its operation or security, submit false or misleading information, or use the Site to send unsolicited commercial messages. We may suspend or block access to anyone who breaches these Terms.

No Guarantee of Placement or Hire

Submitting a resume, completing a form or speaking with a recruiter does not create an obligation on MasterTech to present you to any employer, and does not guarantee an interview, offer or job. Likewise, a request for recruitment services does not guarantee that we will accept a search or fill a role. Any engagement is subject to a separate written agreement between MasterTech and the employer, and that agreement, not these Terms, sets out fees, guarantee periods and other commercial terms.

Job Seekers

MasterTech never charges job seekers a fee. If you send us your resume or personal information, you confirm that it is accurate and current, that you are legally entitled to work in the jurisdiction of any role you apply for, and that we may share it with prospective employers for the purpose of presenting you for a specific opportunity, as described in our Privacy Policy. You are responsible for verifying any offer of employment directly with the employer before acting on it.

Employers

If you contact us on behalf of a company, you confirm that you are authorized to do so. Candidate information we share with you is confidential, may be used only to assess that candidate for the role discussed, and may not be forwarded to third parties or retained beyond that purpose. Hiring a candidate we introduced, directly or through another party, is subject to the fee terms in our written agreement.

Intellectual Property

The Site and its content, including text, graphics, logos, photographs, the MasterTech name and the vacancy cost estimator, are owned by or licensed to MasterTech and protected by Canadian and international copyright and trademark law. You may view and print pages for your own personal or internal business use. Any other reproduction, distribution or modification requires our prior written consent.

Third Party Sites and Services

The Site links to and relies on third party services, including Zoho Recruit (applicant tracking and job alerts), Resend (email), Cloudflare Turnstile (bot protection) and Google Analytics. Job listings and applications may be hosted on those platforms under their own terms and privacy policies. We do not control third party sites and are not responsible for their content, availability or practices. A link does not imply endorsement.

Disclaimer

The Site is provided “as is” and “as available.” Job listings, market commentary, salary figures and the output of the vacancy cost estimator are general information only, may be out of date, and are not professional, legal, financial or employment advice. To the fullest extent permitted by law, MasterTech disclaims all warranties, express or implied, including fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Site will be uninterrupted or error free.

Limitation of Liability

To the fullest extent permitted by law, MasterTech and its directors, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profit, business, data or opportunity, arising from your use of or inability to use the Site, from any content on it, or from any hiring or employment decision made in reliance on it. Our total liability for any claim relating to the Site is limited to one hundred Canadian dollars (CAD $100). Nothing in these Terms limits liability that cannot be limited under applicable law.

Indemnity

You agree to indemnify MasterTech against claims, losses and expenses, including reasonable legal fees, arising from your breach of these Terms or your misuse of the Site or of any information obtained through it.

Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. You agree that the courts of Ontario have exclusive jurisdiction over any dispute relating to the Site or these Terms.

Changes

We may update these Terms at any time by posting a revised version on this page with a new effective date. Your continued use of the Site after a change is posted constitutes your acceptance of the revised Terms. If any provision of these Terms is found unenforceable, the remainder stays in effect.
